Terms of use of hospo.com

1. Hospitality Personnel Ltd is registered with the New Zealand Companies office. Hospo.com is the trading name for the website owned and operated by Hospitality Personnel Ltd. All future reference to hospo.com now means that Hospitality Personnel Ltd and hospo.com are the same identity.

2. Services: The subscriber acknowledges that hospo.com is providing an on-line recruitment advertising service ("Services") for use in accordance with the following terms.

3. Changes: Hospo.com may change the services and any resources, equipment, infrastructure, applications or systems (including the look and feel of the site) used by it to provide the services under this agreement.

4. Editing: Hospo.com may change or delete text submitted by advertisers when listing vacancies on hospo.com where hospo.com deems the text is not consistent with its advertising polices. No refund will be made in the event the advertisement is deleted.

5. Payment: Subscribers agree to pay, for the services at the rates set by hospo.com. Hospo.com may change its rates unless they are expressly fixed for a period. All amounts payable under this agreement shall be in the currency of the subscribers place of business. The subscriber will pay any other taxes, duties or levies related to the provision of the services that may be imposed by the governing authority of New Zealand or of the subscribers place of business.

6. The subscriber acknowledges that hospo.com provides an online advertising medium only and no guarantee is made as to the success of the use of the hospo.com website. The subscriber acknowledges that hospo.com does not provide any guarantees on candidates recruited through a subscription to hospo.com.

7. The subscriber further agrees that if Hospo.com provides a temporary employee to the subscriber through its temporary services division, and the subscriber engages the candidate through the subscription within a period of six months from the last date of assignment, then the subscriber agrees to pay the recruitment fee as per the terms outlined in the temporary services contract and account application for the service.

8. Terms Of Use: All Subscribers agree to these terms and conditions for the use of their respective subscription. The Subscriber acknowledges that the subscription was purchased only for the use of a single property or business, and will not be used for any other purpose. In the event the Subscriber uses their subscription for any other purpose, the Subscriber agrees to pay Hospo for that additional use, the amount of such payment to be determined by Hospo, in its sole discretion.

9. Acknowledgment of personal information: The subscriber acknowledges and agrees that as users of hospo.com ("Users") will be transmitting sensitive personal information. The proper management of that information is critical to the success of hospo.com.

10. Information obligations: The subscriber and the subscriber will keep user information confidential and will also include a privacy statement in accordance with the Privacy Act 1993 with every job vacancy it posts to hospo.com and generally ensure it complies with the Privacy Act 1993 at all times when dealing with user personal information.

11. Human Rights Act: It is the responsibility of the subscriber to comply with the Human Rights Act 1993. The Subscriber will indemnify hospo.com for any breaches of the Act connected to the subscriber's use of the Services.

12. Security of subscriber ID and password: The subscriber will be responsible for ensuring the security, confidentiality and proper use of any subscriber login and passwords allocated to the subscriber ("Login") and ensure that only its authorised employees and agents have access to its Login.

13. Obligation to monitor hospo.com: The subscriber acknowledges that in respect of the communication of data and information between subscriber and user, hospo.com?s sole responsibility is as facilitator of that communication. The subscriber is responsible for all content and communications and indemnifies hospo.com against all claims relating to the content or communications.

14. Candidate Information: Hospo will endeavor to provide the Subscriber with accurate details of the Candidates. However, the Subscriber acknowledges that these details are based on the information supplied to Hospo by the Candidates. Hospo.com does not warrant or give any guarantee as to the suitability of the Candidate for any position with the subscriber.

15. Subscriber Indemnity: The subscriber indemnifies hospo.com against all liabilities, losses, costs, expenses, damages, penalties or fines that may be suffered or incurred by Hospo.com as a result of or in connection with the subscribers use of Hospo.com.

16. Consumer Guarantees Act does not apply: The subscriber acknowledges it is acquiring the Services for business purposes and agrees the provisions of the Consumer Guarantees Act 1993 will not apply.

17. Amendment: hospo.com may change these terms on notice to the subscriber. This may include placing amended terms on the hospo.com website and advising the subscriber accordingly.
